“Probation, given the age, is about the only outcome that could happen here,” he said, adding that no arrest warrant would be issued for the child, who will have a lawyer appointed to represent them. Any proposed probation would not last beyond the age of 21, he said, adding that compulsory therapy and counselling are likely. Tim Ruestman, the Woodford County Coroner confirmed the fire was started intentionally.
The suspect is to be appointed an attorney and will be subject to a bench trial, in front of a judge. The suspect is likely not to be imprisoned, but rather, receive probation for the incident. Minger said that therapy and counseling for the boy would be likely as well. Within minutes of firefighters responding to the scene, the home was engulfed in flames. Gloria Browne-Marshall, a constitutional law professor at John Jay College, said the murder charge on a child is an abuse of power by the prosecutor. "I think he should go somewhere until he's legal age to go to juvie," Samantha said. "Then I think he should go to juvie. And then from juvie to prison. Because at the end of the day, whether he meant to or not, he knew what fire did." Since the incident, Kyle's mother Katie Alwood has been hit with a gag order restricting her ability to talk about the case.
A 9-year-old has been charged with five counts of first-degree murder in connection with a mobile home fire that killed five people. Feeney appointed public defender Peter Dluski for the boy, the Journal Star reported. If found guilty, he likely will face probation because he would be too young to be sentenced to any juvenile detention center. Lauren Swain testified that they normally have a babysitter stay at the house but didn’t on that day the children were left home to perish in the flames. At the time, he did not care about making this message publicly because he "did not care for social media" but in 2019, Messner wanted people to know about his side of the story. He claims he never saw an episode and he does not plan to because of this tragic incident.

The Woodford County Coroner earlier ruled that the fire was started intentionally, the Journal Star reported. Alwood said her son had been recently diagnosed with a form of schizophrenia, ADHD, and bipolar disorder, and that he is a loving boy who deserves a second chance. Under Illinois law, a suspect younger than 10 cannot be detained. And a minor is not given a public jury trial and not entitled to one — unless the minor is charged as an adult.

No child as young as this one has been accused in a mass killing since at least 2006, records show. Minger said the decision to seek a gag order was made by DCFS and covered the boy’s parents and other parties to the case. DCFS took the boy into protective custody after the fire and he’s been a ward of the state since, according to the agency.
